OurSpacely Platform Rules & Enforcement Policy

These Platform Rules & Enforcement Policy (“Platform Rules”) govern all activity on the OurSpacely platform. They apply to all users, including Hosts, Guests, and any other individual or entity accessing or using the platform.

By accessing, listing, booking, hosting, or otherwise using OurSpacely, you agree to comply with these Rules as a binding condition of use. Failure to comply may result in immediate enforcement action without prior notice.

  1. Platform Authority & Scope

OurSpacely operates a digital marketplace that facilitates temporary, revocable, licensed access to spaces. OurSpacely is not a party to any access arrangement, does not own, control, or operate listed spaces, and does not guarantee the condition, legality, or suitability of any space.

OurSpacely reserves sole and absolute discretion to interpret, apply, and enforce these Platform Rules.

  1. Mandatory Compliance

All users must:

Comply with all applicable federal, state, and local laws

Follow zoning, occupancy, safety, health, and building regulations

Act honestly, accurately, and in good faith

Respect other users, neighbors, and surrounding communities

Use the platform only for lawful, permitted purposes

No user may claim ignorance of these Rules as a defense.

  1. Host-Specific Rules

Hosts must:

Have lawful authority to grant temporary licensed access to the listed space

Ensure listings comply with all applicable laws, HOA rules, lease terms, and private agreements

Provide accurate descriptions, availability, and pricing

Maintain spaces in a reasonably safe and lawful condition

Refrain from misleading, deceptive, or incomplete listings

Hosts may not:

Offer access they are not legally permitted to grant

Circumvent platform fees or payments

Use the platform to disguise prohibited rentals, tenancies, or subleases

Permit illegal, unsafe, or unauthorized activities

  1. Guest-Specific Rules

Guests must:

Use spaces only for the purpose disclosed in the booking

Respect time limits, access conditions, and host instructions

Comply with all laws, safety requirements, and posted rules

Leave spaces in reasonable condition

Guests may not:

Overstay access periods

Transfer access to third parties

Engage in illegal, unsafe, disruptive, or nuisance activities

Misrepresent identity, purpose, or intent

  1. Prohibited Conduct (Zero Tolerance)

The following are strictly prohibited:

Illegal activity of any kind

Fraud, misrepresentation, or impersonation

Harassment, discrimination, or abusive behavior

Property damage, theft, or vandalism

Unauthorized surveillance, recording, or monitoring

Weapons, hazardous materials, or unsafe practices

Circumventing platform systems, fees, or safeguards

Violation may result in immediate removal and permanent ban.

  1. Safety & Community Impact

Users must not create safety risks or community disturbances, including but not limited to:

Excessive noise

Unauthorized gatherings

Unsafe occupancy levels

Disruption to neighbors or shared spaces

OurSpacely prioritizes community safety over user convenience.

  1. Listing Review, Takedown & Suspension Authority

OurSpacely reserves the right to:

Remove or suspend any listing at any time

Cancel access arrangements

Restrict visibility or functionality

Suspend or terminate accounts

Withhold payouts where permitted by law

Cooperate with law enforcement or regulatory authorities

No warning, explanation, or investigation is required prior to action.

  1. No Right to Appeal

Appeals, reviews, or reinstatement are entirely discretionary. OurSpacely is under no obligation to reinstate users or listings once enforcement action has been taken.

  1. Reporting & Cooperation

Users are encouraged to report violations. OurSpacely may act on reports, internal reviews, automated systems, or external information.

Users must cooperate with reasonable investigations. Failure to cooperate may itself result in enforcement action.

  1. No Waiver

Failure to enforce any provision of these Rules does not constitute a waiver of OurSpacely’s rights.

  1. Modifications

OurSpacely may update these Platform Rules at any time. Continued use of the platform constitutes acceptance of the revised Rules.

  1. Governing Law

These Platform Rules are governed by the laws of the State of California, without regard to conflict-of-law principles.
